Memorandum sent on 29.09.2009 to Lt. Governor, Chief Secretary, Director General of Police and Senior Supt. of Police (Law & Order) of Puducherry:
Mr. G.A. Jaganathan, a dedicated activist and Karikkalampakkam Village President and State Panchayat President Federation’s Vice-President was working for the downtrodden people for more than three decades. He is constantly working for the delegation of powers to the Village Panchayats in Puducherry.
On 28.09.2009, at about 1.30 PM, One Indrajit S/o Ranganathan of Karikkalampakkam Village brutally attacked one Shanmugam S/o Balakrishnan of same village before the Village Panchayat Office, due to some dispute in work, since both of them are construction laborours.
He was severely injured in head and right hand. The said Shanmugam is very close to the said Mr. G.A. Jaganathan and in free time he will be with him helping at his office.
At that time of occurrence Mr. G.A. Jaganathan was in Puducherry town and the said victim Shanmugam informed him over cell phone about the incident. He immediately directed him to go to the Hospital for treatment and also to Karikkalampakkam Out Police Station to complain the incident for necessary criminal action. Obeying to his instruction he went to the Karikkalampakkam Government Hospital for treatment. He was treated there and since the injury was heavy three sutures were put in his head and the Hospital Doctor registered the case as Medico Legal Case (MLC). Subsequently, he went to the Police Station and complained about the incident in writing at about 2.00 PM.
But, the Police never registered his complaint and not even took any small effort to secure the said Indrajit. The hapless victim simply returned home leaving his complaint copy in the Police Station.
On the same day at about 5.30 PM, the same person Indrajit, who involved in the said incident came to the Village Panchayat Office knowing that the victim Shanmugam is there. At that time, the said victim Shanmugam was inside the office narrating the incident to Mr. G.A. Jaganathan and others. Suddenly, the said Indrajit shouted and scolded using filthy languages against Mr. G.A. Jaganathan and others. The people gathered there tried their best to pacify him. But, he suddenly took some bricks and thrown it with force against them. In retaliation, few of the gatherings beaten up him and pushed him towards the road to avoid any further incident. At that time, as a local leader Mr. G.A. Jaganathan shouted and tried his best to avoid this incident but in vain.
Suddenly, as well planned the said Indrajit with very few of his supporters, as numbered by the media persons as twelve, created a big show of road block and also unnecessary trouble to the public. At this time also the Police action was not in time and as a result stones were thrown on buses and three buses were severely damaged.
We were informed by our friends about these incidents and we, (myself and my friends Mr. M. Ilango of Periyar Dravidar Kazhagam and Mr. Swaminathan of Students’ Federation) rushed to the spot to assist the victims. Around 8.30 PM, we reached Karikkalampakkam Village and enquired the people concerned and reached the Police Station at about 9.30 PM. At that time the Police Station was full of Police Officers of rang of Inspector of Police and below. We just interacted with the Villianur Circle Inspector Mr. Bairavasamy about the incidents. He narrated us the incidents briefly.
We humbly submitted before him that the first occurrence was at 1.30 PM and if the Police acted on the complaint of the said victim Shanmugam and if Indrajit was arrested in time, there is no chance for the subsequent incidents. We are sorry to state here that the said Villianur Circle Inspector replied that ‘he came to know about the incident now only.’ That is after 8 hours of the incident. Till that time no FIR was filed on the said complaint. He also assured that he will take severe action in accordance with Law on the persons involved in these violent incidents.
But, Instead of taking action against the real persons involved in the violence, the Police filed the FIR against Mr. G.A. Jaganathan and his younger brother, son and the said victim Shanmugam. Unfortunately, the Police arrested Mr. G.A. Jaganathan in the mid-night and suddenly shifted him to the Villianur Police Station and we came to know that he will be remanded to Judicial Custody today (29.09.2009).
Hearing about the arrest of Mr. G.A. Jaganathan, we rushed to the Villainur Police Station at about 12.00 AM today and met the said Circle Inspector Mr. Bairavasamy. But he never turned up to give any information about his arrest and acted in a rude manner. At that time a large number of Village Panchayat leaders gathered before the Police Station.
In this context, we would like to emphasize your authority that the Police personals attached to the Karikkalampakkam Out Police Station and the Villianur Circle Inspector Mr. Bairavasamy are the sole persons responsible for the violence occurred. The inaction of Police only created unwanted violence.
We came to know from reliable source that owing to some political pressure the Police Officers foisted false case against Mr. G.A. Jaganathan and his family members to threaten him and curtail his reasonable activities and struggles for the poor people.
It is also proper to note here that the 11 Commandments of Supreme Court in D.K. Basu Case was simply ignored by the said Police Officers during the arrest of Mr. G.A. Jaganathan and in broader view the arrest was unwarranted, since he was a well known leader and a sincere law obedient citizen.
So, we kindly request your authority to order for an Independent Enquiry into the whole incidents to ascertain the facts and take stern action against the said Officer and personals, who were merely spectators of violence and violated the Law and negligence in duty. Also take severe action against the said Indrajit and others who were responsible for the whole violence disturbing the peaceful life of the people.
